Waynesboro man on moped killed in July 4 collision

A 50-year-old man riding a moped was fatally injured late Friday night in a collision with a Ford minivan on North Delphine Avenue.
Waynesboro police said James Michael Baber, 50, of Waynesboro, suffered a severe head injury in the collision.
Baber died around 2:35 a.m. Saturday at the University of Virginia Medical Center in Charlottesville. He was taken there after first being treated at Augusta Medical Center.
Baber turned left while riding a 2004 Yamaha moped onto North Delphine Avenue about 10 Friday night.
He made the turn while heading south from 6th Street.
Police said Baber then swerved into oncoming traffic. He was not wearing a helmet.
Sgt. Michael Wilhelm of the Waynesboro Police said it is not known if Baber was drinking, and said there was nothing at the accident scene to suggest alcohol had been used.
Neither the driver of the Ford Windstar minivan, Nora Quezada, 25, of Waynesboro, nor the two children who were passengers in the minivan were injured.
Police said Quezada was charged with operating with a suspended driver’s license.
No other traffic charges are expected.

I agree with VaGirl, this could have been avoided if the van driver had obeyed the law. A criminal charge for vehicular homicide seems to be in order along with any driving offenses as the accident happened while she was breaking the law. She made the choice to drive illegally, she must face the consequences of her actions.

The death of any driver of a non-automobile vehicle is always a tragedy. This driver has practically no chance of escaping death if there is a collision with a car. For this reason, and for the reason that we are going to see many more mopeds, scooters, bicycles, and motorcycles on the highways, auto drivers must learn to pay more attention to those drivers and take care to avoid a collision. The car driver is in a good position to do this and it should be his responsibility to do everything that is possible to avoid a collision. There is no equal standing between the car driver and the moped driver, the risks are so unequal. In other words, there is a higher standard of care on the car driver.

excuse me..she was driving on a suspended license..is that not against the law????? and why was her license suspended? people automatically get arrested for driving on a suspended license and have faced criminal charges when involved in an accident.she took someone’s life when she was not legally suppose to be driving....
